Terms of Service

Last updated: November 2, 2026

These terms are an agreement between you and Increation, of 1968 S. Coast Hwy #1921, Laguna Beach, CA 92651, United States ("Increation", "we", "us"). They cover your use of the Increation website and studio (the "Service"). By signing in or using the Service you accept these terms, our Privacy Policy, our Content Policy and our Cookie Policy. If you don't accept them, don't use the Service.

Section 13 contains an arbitration agreement and a class-action waiver. Unless you opt out as section 13 explains, disputes between you and us are resolved by individual arbitration, not in court or as part of a class action.

1. What Increation is#

Increation lets you create images and videos by sending a text prompt, and optionally your own reference images, to AI models made by other companies. We don't train our own models. Requests to the model providers route through Vercel's AI Gateway to the provider whose model you picked. In Creator you can also talk to Creatorb out loud. Its voice is an AI voice from OpenAI, and it's never a person. The models available can change at any time. We may add, change or remove models and features, or stop offering the Service, without notice.

The Service is provided as it is. We don't promise it will always be available, that any model will stay available, or that a generation will match what you asked for.

2. Who can use it#

You must be at least 18 years old, or the age of majority where you live if that is higher. Several of the model providers we route to require this.

3. Your account#

  • You sign in with Google or Apple. We don't offer passwords.
  • Your account is for you alone. Keep access to it secure, and tell us at legal@increation.ai if you think someone else has used it.
  • You're responsible for what happens under your account.
  • We may suspend or close an account that breaks these terms or the Content Policy, or that puts the Service, other people or our providers at risk. Where it's reasonable and lawful, we'll tell you why.
  • You can stop using the Service at any time. To have your account closed and your data deleted, email legal@increation.ai from the email address you sign in with. We'll do it within 30 days. The Privacy Policy explains what that deletes and what we must keep.

4. Credits#

  • Generating spends credits. Each model shows its price in credits before you generate, and the price can differ by model, by setting and, for video, by length.
  • Free signup credits. A new account gets 100 free credits, once, the first time you sign in with a verified email address. Free credits don't expire.
  • Failed generations. If a generation fails, or doesn't finish within ten minutes, its credits are returned to your balance automatically.
  • Credits have no cash value. They can't be transferred, sold or exchanged for money, and they can only be spent on the Service.
  • We may change model prices. A change never alters the price of a generation you have already started.
  • Buying credits. You can't buy credits yet. When purchases launch, payments will be handled by our payment processor, and we'll show the price and any taxes before you pay. Purchased credits are not refundable, except where the law requires a refund or when a generation fails, in which case its credits come back to your balance automatically. The payment terms in this section apply once purchases launch.

5. What you create#

You own your outputs. Increation makes no claim of ownership over the images and videos you generate ("Outputs") or over the prompts and images you put in ("Inputs"). As between you and Increation, you own your Inputs and your Outputs, to the extent the law allows. Your rights are also subject to the terms of the model provider that made the Output (see section 7).

You can use them commercially. You may use your Outputs for any lawful purpose, personal or commercial, inside or outside Increation. Credit to Increation is not required.

Some things are worth knowing:

  • Outputs may not be unique. A model can produce the same or similar output for someone else, and their rights in that output are not affected by yours.
  • Copyright may not exist. In some countries, purely AI-generated material may not be protected by copyright. We can't promise that you can enforce rights in an Output against others.
  • You're responsible for how you use Outputs. Something you generate may resemble existing work, a trademark or a real person. Check before you rely on an Output, especially commercially.

The license you give us. You give Increation a worldwide, non-exclusive, royalty-free license to host, store, copy, process and transmit your Inputs and Outputs. We use it only to run the Service for you: to send your prompt and images to the model you picked, to store results, to show them back to you in your studio and history, and to show them to others when you choose to share them. This license ends when you delete the content, except for copies we must keep for the reasons in the Privacy Policy.

Sharing is your choice. Everything you make is private to your account unless you choose to share it. If you share a generation by link, anyone with the link can see it. If you publish it to the Gallery, anyone can see it. A shared item shows its prompt unless you turn that off, and you can make it private again at any time, which stops the link working. We won't use your Inputs or Outputs in our showcase or marketing without your consent.

6. Your responsibilities#

You agree to follow the Content Policy. In short:

  • Only upload Inputs you have the right to use. You confirm that you own, or are licensed to use, any trademarks, logos and brand assets you include, including a client's you make work for.
  • Don't create anything illegal, anything that infringes someone else's rights, sexual content involving minors, or non-consensual intimate or deceptive content about real people.
  • Don't remove or tamper with provenance data or watermarks that models add to Outputs, such as C2PA Content Credentials or SynthID.
  • Don't present an Output as made by a person, or as a real photograph of a real event, when it isn't.
  • Don't use Outputs or the Service to train or develop AI models.
  • Don't scrape, overload, reverse engineer, resell or get around the limits of the Service (including rate limits and the credit system), and don't use it to build a competing product.

7. Model providers#

Each generation is made by a third-party model, and that provider's usage policy applies to what you create with it. Using a model means you agree to follow its provider's policy:

  • OpenAI (image models and Creatorb's voice): Usage Policies
  • Google: Generative AI Prohibited Use Policy
  • Black Forest Labs: FLUX Usage Policy. We use Black Forest Labs' models through their API, under their API terms.
  • xAI: Acceptable Use Policy
  • Recraft: Developer Terms
  • Kling (Kuaishou): Community Guidelines. We use Kling's models through their API, under their API terms.
  • Alibaba Cloud (Wan): Product Terms, Model Studio section. We use Wan through Alibaba Cloud Model Studio's API.
  • fal: Acceptable Use Policy. fal hosts some models for us, including Alibaba's HappyHorse and Lightricks' LTX-2.3. We call fal from our own servers, under its Terms of Service and API Services Terms; your browser never talks to fal.
  • Lightricks (LTX-2.3): the use restrictions in the LTX-2 Community License (Attachment A). LTX-2.3 is an open model, and we run it on fal.
  • ElevenLabs (voice, music and sound effects): Prohibited Use Policy, and the restrictions in its Terms of Service. We call ElevenLabs from our own servers, under its API terms and Music Terms. ElevenLabs is a third-party beneficiary of these terms for the parts that cover its services, and may enforce them. You let ElevenLabs process the Inputs you send to its models so it can provide them. Music made with ElevenLabs may be used commercially online and offline, but not in film, TV, radio or studio games. Music prompts can't name artists, songwriters, songs, albums, publishers or labels, or quote lyrics.
  • Stability AI (Stable Audio 2.5, music and sound effects): Acceptable Use Policy. We run Stable Audio 2.5 on fal.
  • ByteDance (Seedance 2.5, video): fal's Acceptable Use Policy applies, as fal publishes no separate ByteDance policy for it. We run Seedance 2.5 on fal's US-hosted service.
  • MiniMax (Hailuo and H3, video): the prohibited uses in its Terms of Service, as MiniMax publishes no separate usage policy. We run MiniMax's models on fal.
  • PixVerse (video): Community Guidelines. We run PixVerse on fal.
  • VEED (Fabric, talking clips): Code of Conduct. We run Fabric on fal.
  • Topaz Labs (video upscaling and slow motion): its Terms and Conditions, and fal's Acceptable Use Policy, as Topaz publishes no separate usage policy. We run Topaz's models on fal.
  • Ideogram (Ideogram 4, images): Usage Policy. We run Ideogram 4 on fal.
  • HeyGen (avatars, video and translation): Acceptable Use and Moderation Policy. We run HeyGen's models on fal.
  • Luma (Ray, video): the acceptable use rules in its Terms of Service. We run Luma's models on fal.
  • Creatify (Aurora, talking clips): Moderation Policy. We run Aurora on fal.
  • Sync Labs (lip sync): the prohibited uses in its Terms of Service. We run Sync Labs' models on fal.
  • Anthropic (Chat and prompt enhancement): Usage Policy

Requests reach these providers through Vercel's AI Gateway, under Vercel's AI Product Terms, with two exceptions: our servers call fal and ElevenLabs directly, and when you talk to Creatorb your browser streams your voice straight to OpenAI.

When you talk to Creatorb, don't do it where other people can be heard unless they've agreed.

A provider can ask us to suspend an account that breaks its policy, and we may do so. Generated audio, like any Output, may not be unique: another user can get something similar. Platforms such as YouTube, TikTok and Instagram have their own rules for labelling AI-generated audio, and may flag or claim it. Follow those rules when you publish.

Providers may filter or refuse prompts and outputs on their own. If a provider refuses or fails a generation, its credits come back to you (section 4).

8. Our property#

The Service itself belongs to Increation or our licensors: the software, design, name, logos and the content we publish (including our showcase work). These terms don't give you any rights in it except the right to use the Service as described here. Provider names and logos belong to their owners.

If you send us feedback or ideas, we may use them without owing you anything.

If you believe something on the Service infringes your copyright, send a notice to our designated copyright agent:

Copyright Agent, Increation1968 S. Coast Hwy #1921, Laguna Beach, CA 92651, United Stateslegal@increation.ai

The notice must include:

  • your contact details;
  • the work you say is infringed;
  • where the material is on the Service;
  • a statement that you believe in good faith the use isn't authorised;
  • a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for them;
  • your signature.

We'll act on valid notices and may close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address.

10. Disclaimers#

The Service and all Outputs are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. AI models can produce inaccurate, unexpected or offensive results. We don't guarantee that the Service will be uninterrupted, error-free or secure, or that stored content will never be lost. Keep your own copies of anything that matters to you.

11. Limitation of liability#

To the extent the law allows, Increation is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places don't allow these limits, and there they apply only as far as the law permits.

12. Indemnity#

You agree to defend and compensate Increation for claims, losses and costs (including reasonable legal fees) that arise from your Inputs, your use of Outputs, or your breach of these terms or of a provider's policy.

13. Disputes and governing law#

Governing law. These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If you live in the European Economic Area, the United Kingdom or Switzerland, you keep the protection of any mandatory consumer law where you live.

Talk to us first. Before starting arbitration or any other formal claim, email legal@increation.ai with your name, the email address you sign in with, a description of the dispute and what you want. We'll do the same if we have a dispute with you. Both sides then have 60 days to try to resolve it informally before either starts a formal claim.

Arbitration. If the dispute isn't resolved within those 60 days, you and Increation agree to resolve it by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. This covers any dispute about these terms or the Service, including whether this arbitration agreement applies. An arbitrator, not a judge or jury, decides the dispute, and you and Increation give up the right to a trial in court. The arbitrator can award the same individual relief a court could.

No class actions. You and Increation may bring claims against each other only individually, not as a plaintiff or class member in any class, consolidated or representative action. The arbitrator may not combine more than one person's claims.

Small claims. Either side may instead bring an individual claim in small claims court, as long as it stays there.

Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these terms. Email legal@increation.ai from the email address you sign in with and say that you opt out of arbitration. Opting out doesn't affect any other part of these terms.

Courts. Any dispute that isn't arbitrated, including if you opt out, or if a court finds that this arbitration agreement doesn't apply, is heard only in the state or federal courts in Orange County, California, and you and Increation consent to their jurisdiction. If the class-action waiver is found unenforceable for a claim, that claim goes to those courts and not to arbitration.

14. Changes to these terms#

We may update these terms. For a material change, we'll give you at least 14 days' notice before it takes effect, by email to the address on your account and by a notice in the Service. Other changes take effect when we post them, and the date at the top of this page will change. If you keep using the Service after a change takes effect, you accept it. A change to section 13 doesn't apply to a dispute we already know about.

15. General#

  • These terms, together with the policies they link to, are the whole agreement between you and us about the Service.
  • If any part turns out to be unenforceable, the rest still applies.
  • If we don't enforce a right, that doesn't waive it.
  • You may not transfer these terms. We may transfer them as part of a merger, an acquisition or a sale of assets.
  • These sections survive the end of your use of the Service: 5 (except our license, as described there), 8 and 10–15.
